The Tokyo Commodity Exchange (TOCOM) recognizes the importance of protecting the personal information it acquires, in compliance with statutes on the protection of personal information, including the Personal Information Protection Law, and their objectives. TOCOM therefore takes the following measures for the protection of personal information.
This policy will be posted on TOCOM's website, so it can be viewed at any time.
1. Recognition of importance
TOCOM deals with various types of personal information in the process of carrying out business. In recognition of the importance inherent from the fact that the same is protected by statutes on the protection of personal information, including the Personal Information Protection Law, TOCOM shall protect all personal information in the course of acquiring, utilizing and managing the same.
2. Observance of statutes
When TOCOM handles personal information in the performance of its business, it shall observe the statues for the protection of personal information, including the Personal Information Protection Law.
3. Specification of the purpose of use
TOCOM shall use personal information exclusively for the purposes below, and shall not use the same for any purpose other than the following, except as specified in statutes.
(1) Personal information on personnel at member institutions
Communication and work with the members’ Representative to the Exchange and person in charge, operations necessary for performing the same, and any and all operations incidental to the same.
Said information may be made available to a competent ministry, members of TOCOM and affiliated organizations.
(2) Personal information on customers
Matters related to customers, such as management of large positions, delivery, demands for refund, grievance procedures, operations necessary for performing the same, and any and all operations incidental to the same.
Said information may be made available to a competent ministry, taxation authorities, and trade organizations.
(3) Personal information on registered representatives
Operation and administration of training courses and examinations organized by TOCOM, operations necessary for performing the same, and any and all operations incidental to the same.
Said information may be made available to trade organizations including the Commodity Futures Association of Japan.
(4) Personal information on part-time directors and committee members
Communication and work for the board of directors and committee, operations necessary for performing the same, and any and all operations incidental to the same.
Said information may be made available to members of TOCOM, affiliated organizations, and the mass media.
(5) Personal information on employees, etc., of TOCOM
Appointment and dismissal of directors, recruitment, personnel affairs, supervision, disciplinary actions, and paperwork related to employees, operations necessary for performing the same, and any and all operations incidental to the same.
Said information may be made available to health insurance associations, tax offices and other public agencies.
4. Proper acquisition
TOCOM shall not acquire personal information by any dishonest means.
5. Publication of the purposes of use
TOCOM shall publish the purposes of its use of personal information via appropriate means (website, etc.), except as specified in statutes.
6. Assurance of accuracy of data
TOCOM will strive to keep personal information accurate and up-to-date to the extent necessary to achieve the purposes of its use.
7. Safety measures
TOCOM shall take safety measures, including supervision of its employees and subcontracting partners, to prevent mishaps related to personal information such as falsification, destruction, loss and leakage.
8. Provision to third parties
TOCOM does not provide the personal information it has acquired to third parties, except as agreed upon by the subject of said information and specified in statutes.
9. Request for disclosure, etc.
TOCOM will handle requests for the disclosure, etc., of personal information from the subject of the same in accordance with the statutes on the protection of personal information.
10. Observance, etc., of bylaws
TOCOM will establish bylaws, ensure their observance by its directors and employees, and provide education and training for the protection of personal information.
11. Inquiries, grievance procedures
TOCOM shall respond to inquiries and complaints concerning the handling of personal information by TOCOM both appropriately and promptly, in accordance with the statutes on the protection of personal information and the regulations it establishes.
